1. Definitions
- These Terms of Service will be referred as (“Terms”)
- Scope 360 AB is the company providing the Chrome extension and related services, which will be referred to as (“Service Provider”, “we” or “us”).
- Scope360° Chrome extension and any related services provided by the Company, which will be referred to as (“Service”).
- Any individual or entity using the Service is referred to as (“Customer” or “you”).
2. Acceptance of Terms
These Terms govern your use of the Service. By installing or using our Service, you agree to be bound by these Terms. If you do not agree with any part of the Terms, you may not use the Service.
3. Eligibility
You must have the legal capacity to form a binding contract to use this Service. By using the Service, you represent and warrant that you meet this requirement.
4. Account Registration and Security
To access certain features of the Service, you may be required to register an account. You agree to provide accurate and complete information during the registration process and to keep this information up-to-date. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
5. Acceptable Use
You agree not to use the Service in any way that:
- Violates any applicable laws or regulations.
- Engages in any activity that exploits, harms, or attempts to exploit or harm any individual.
- Involves reverse engineering, decompiling, disassembling, altering, modifying, or creating derivative works based on the Service or any part of it.
- Attempts to gain unauthorized access to the Service, user accounts, or other systems or networks.
- Circumvents or attempts to circumvent any security measures implemented by the Service Provider.
6. User Data and Privacy
Your use of the Service is also governed by our Privacy Policy. The Service Provider collects and uses your data as described in the Privacy Policy. This includes:
- A hash of the Jira instance URL and a hash of the user email address sent to the Service application server for configuration.
- Storage of Jira Username and password, encrypted in the browser local storage, used only for logging into Jira and not sent elsewhere.
7. License and Intellectual Property
The Service Provider grants you a limited, non-exclusive, non-transferable license to use the Service. All intellectual property rights in and to the Service, including but not limited to software, content, and trademarks, remain with the Service Provider and its licensors.
8. Acceptable Use
You agree not to use the Service in any way that:
- Violates any applicable laws or regulations.
- Engages in any activity that exploits, harms, or attempts to exploit or harm any individual.
- Involves reverse engineering, decompiling, or disassembling the Service.
- Attempts to gain unauthorized access to the Service, user accounts, or other systems or networks.
9. Payment and Subscription
The Service is a paid service. By subscribing to the Service, you agree to pay the fees specified. Payment terms, including billing cycles and refund policies, will be detailed at the point of purchase. Subscription fees are non-refundable except as required by law.
10. Modifications to the Service
The Service Provider reserves the right to modify or discontinue the Service at any time. We will notify you of any significant changes through the Service or by other means. Your continued use of the Service after changes are posted constitutes your acceptance of the changes.
11. Termination
The Service Provider may terminate or suspend your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination will survive.
12. Disclaimers and Limitation of Liability
The Service is provided “as-is” and “as available”. The Service Provider disclaims all warranties, express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. In no event shall the Service Provider be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.
13. Indemnification
You agree to indemnify, defend, and hold harmless the Service Provider, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees arising out of or relating to your use of the Service or violation of these Terms.
14. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Service Provider is headquartered, without regard to its conflict of law principles. Any disputes arising under or in connection with these Terms shall be resolved through binding arbitration or mediation, as agreed upon by both parties.
15. Miscellaneous
- Severability: If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions will remain in full force and effect.
- Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Service Provider regarding your use of the Service.
- Waiver: No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or any other term, and the Service Provider’s failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
